Article 256, paragraph 1 states that: Any act of sexual penetration of any kind committed against the person of another, with violence, coercion, threat, surprise or deception, shall constitute rape, regardless of the nature of the relationship between the aggressor and his victim, even if they are married. If the victim is under fifteen years of age, the absence of consent shall always be presumed.
