On 17 March 2023, the government announced a proposal to amend the child protection law. Article 2-1 of the draft law expands the definition of information harmful to the health and development of children as follows: “[information] that denounces family and traditional societal values, promotes non-traditional sexual relations and initiates disrespect towards parents or other family members”. The bill was passed by the parliament on 22 June 2023 and signed into law by the president on 14 August 2023. Unlike Hungary's "law on the protection of children" , the law does not mention sexual orientation or homosexuality explicitly. The law also does not define "family values" and "non-traditional sexual relations".

With the entry into force of the new Law on Civil Status Acts (Law No. 110), direct provisions instructing registry offices regarding administrative gender change were removed from the text of the law. However, the new legislation did not introduce any explicit prohibition on modifying birth records for this reason. Under the fundamental legal principle that "what is not prohibited by law is permitted," legal gender change remains permissible, though the process shifted from a purely administrative track to a judicial one. Due to the lack of dedicated administrative regulations, applicants can pursue legal gender correction by filing a civil lawsuit to establish a fact of legal significance. Based on a final and binding court judgment, civil registry offices remain legally obligated to update the gender marker and issue new identity documents, which de facto maintains the legality of this procedure within the Kyrgyz legal system.

Legal gender recognition was officially regulated by statute and fully available in an administrative procedure. According to Article 72 of the Law on Acts of Civil Status (Law No. 60), civil registry offices had a legal obligation to amend birth records based on a certifying document issued by a medical institution. This framework was further formalized in 2011 through the Rules for the Registration of Civil Status Acts, issued by the State Registry Service under the Ministry of Justice, which explicitly authorized civil servants to modify the first name, surname, and patronymic in civil registries upon the submission of a statement confirming the performed medical intervention.

Operating under the legal framework of the Soviet Union, legal gender recognition became possible under Resolution No. 1006 issued by the Council of Ministers of the USSR. Item 2, sub-item 't' of these basic provisions explicitly allowed for the correction of personal data in civil registry records due to a change of sex. Civil Registry (ZAGS) offices processed these changes based on medical certificates, strictly conditioning the administrative amendment on the applicant having undergone surgical correction. This medicalized procedure was further formalized by the USSR Ministry of Health's "Methodological Guidelines for the Change of Sex" (No. 10-91) on August 30, 1991, which established strict diagnostic criteria for transsexualism. Following its independence in 1991, Kyrgyzstan fully inherited this medicalized Soviet administrative practice, which remained in use until the adoption of its own national legislation in 2005.
