Description | The Law on Equality (Law No. 28) (2006) does not include "gender identity" among its protected grounds. For its part, the Penal Code, as amended in 2018, includes "gender identity" but it does not include acts of discrimination in healthcare. Therefore, protection from discrimination in healthcare based on "gender identity" could only be derived from the criminalisation of acts of discrmination in the provision of goods and services. The Law for the approval of the Istanbul Convention (...) and to amend the Penal Code (...) (Law of July 20) (2018) amended Article 454 of the Penal Code (1879) to criminalise all acts of discrimination based on "gender identity".
