DescriptionOn 1 July 2023, MP Raad Hamdan Al-Maliki submitted a Bill to amend the Law against Prostitution (2023) to the chairman of the Legal Committee. This bill, which renamed the Law against Prostitution (Law No. 8) (1988) as "Law against Prostitution and Sexual Deviance", bans in its Article 3 “changing the biological sex of a person based on psychological desires and inclinations by changing the gender identity”. Under Article 6, anyone who changes their “biological sex”, or attempts to do so, shall be punished by imprisonment for one to three years. The same penalty would apply to every doctor or surgeon who performs the operation, except for the case of treating “congenital anomalies that require surgical intervention to confirm a person's sex”, thus promoting unnecessary interventions on intersex minors.
The bill was initially removed from the Parliamentary agenda but was reinstated after MP Al-Maliki opposed it. It was reported in April 2024 that Iraq's Parliament had passed it into law.
