To say this makes sex outside marriage is illegal is inaccurate for two reasons: in practice consenting adults who have sex outside marriage (either done by those who are married or not with children or not) is done frequently, the second is that this article is a loophole because one of its clause specifically mentioned that the only people that can file a complaint are: in the case of married individual: their spouse, in the case of non married individual: the children of the individual or their parents. Attentive readers would realize immediately that no parent would put their own child to jail nor would most couples who had sex outside marriage have children. This article also has a clause that said that the complaint maybe withdrawn before the trial begins. At the addendum on the further explanation section of the law, for this article it is also mentioned that this law would overturn and held more prominence than any other law that came before it which actually legalize sex outside marriage between consenting adults and prevent events in the past where a couple were prosecuted because they got caught of having sex by people other than their parents or their child. Regional laws regarding this would also effectively be rendered useless because this law has a really high precedence right after the constitution.
I would also add that one of the reasons the government put this law was to give legal path for a spouse who got cheated by their partner, and for giving a space for the religious parties at the parliament (because to remove this clause they would get protest from the religious, to include it they would get protest from the secularist). Effectively, like many laws in Indonesia, the government does not take any stand in the matter, hence the loophole to do as little harm as possible."
