- Status is not correct "The National Penal (Code) Act 2017 (Nepal), section 15: "Act done by consent not to be offence: Except where done with the intention of causing death or grievous hurt or with the knowledge that it is likely to cause death or grievous hurt, no act done by a person by obtaining consent of a person above eighteen years of age which causes any harm to the person who has given such consent shall be considered to be an offence." (emphasis added). See also section 20: "Consent: Consent may be expressed orally or in writing or by gesture or conduct. Provided that consent given in any of the following circumstances shall not be considered to be consent:..(c) Where the consent is given by a child below eighteen years of age". However, note the s 219 prohibition on committing rape provides broader definition of rape against women, but does not expressly remove the definition of the crime as against men: "219(1) No one shall commit rape. (2) Where a man has sexual intercourse with a woman without her consent or with a girl child below eighteen years of age even with her consent, the man shall be considered to commit rape on such woman or girl child".
