DescriptionThe French Penal Code of 1791, adopted between 25 September and 6 October 1791, extended to Saint-Domingue. When Haiti became independent from France in 1804, no law that criminalized consensual same-sex sexual acts was introduced, and no such law has come into the penal code since.

  • Status is not correct "Haiti is a very homophobic country. Implying that Haiti allows homosexual activity is very harmful. You can be sent to prison if you are apart of the LGBT & hate crimed. A common punishment for LGBT members in Haiti is being burned alive. "
  • Date is incorrect "Homosexuality was legalized in Haiti in year of 1791, when French Penal Code was introduced."
  • Status is not correct "Gay is not legal in Haiti. Obviously, it is more tolerated those days by the public but be careful not everywhere. The law has prohibited this."
